Legacy Driven Motorsports, LLC and its affiliates, (“Legacy Driven”, “we”, “us” and “our”) are committed to guarding your privacy and the protection of your information. We actively maintain the security of our servers where your information is stored. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. This notice applies to all information collected or submitted on LegacyDrivenMotorsports.com or any other website owned, operated, licensed, or controlled by Legacy Driven, and any associated software, website, web widgets, feeds and applications for third-party websites and services, and any other mobile or web services or applications owned, controlled, or offered by Legacy Driven (collectively, the “Service”).

This Privacy Policy is incorporated into and is subject to the Legacy Driven Terms of Service policy. Your use of the Service and any personal information you provide on the Service remains subject to the Legacy Driven Terms of Service. Any capitalized terms not defined in this Privacy Policy shall have the meanings ascribed to them in such Terms of Service.

What is Personal Information?

Personal information is information that specifically identifies an individual, such as a name, address, telephone number, email address, or other account number, and information about that individual’s activities when directly linked to that person, such as information about his or her use of the Service. Legacy Driven also collects potentially personally-identifying information like Internet Protocol (IP) addresses. Legacy Driven does not use IP addresses to identify its visitors, however, and does not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.

Personal Information We Collect and How We Use It

We collect personal information in a number of ways when you visit the Service. For example, we collect personal information when you: (1) register and set up an account, (2) participate in a Legacy Driven service, (3) interact on our forums or networking sites or (4) contact us by email for any reason. When you visit the Service, some information is also automatically collected, such as your computer’s or mobile device’s Internet Protocol (IP) address, your computer’s or mobile device’s operating system, the browser type, the address of a referring website, and the time and date of your visit and interactions with the Service. We treat this information as personal information if we combine it with or link it to any of the identifying information mentioned above. Furthermore, if you make any purchases through the Service, billing and credit card information may be required. All such credit card transactions are fully encrypted and your billing and credit card information is collected and stored by us or a trusted third party. Any third party credit card vendor will be prohibited from using this information for any purpose other than storing the credit card.

While most of the information we collect is provided voluntarily by you, some of the information we collect may be collected automatically by use of a “cookie.” Cookies are small text files that reside on your computer and identify you as a unique user. Cookies allow us to, among other things, measure activity on our website and to personalize your experience with the Service. For instance, cookies may enable us to remember your viewing preferences without requiring you to re-type a user name and password. Our Commitment to Children’s Privacy

Protecting children’s privacy is especially important to us. For that reason, we never knowingly collect or maintain information from those we know are children under 13. If we discover we have received any information from a child under 13, we will delete that information immediately. Using and Sharing of Your Information

We use the information that we collect to better understand how visitors use our websites, to complete a contact or request, to provide the Service, to better understand your needs, to provide to Legacy Driven marketing, to improve our products and services, and to contact you.

Legacy Driven discloses potentially personally-identifying and personally-identifying information only to those of project administrators, employees, contractors, and affiliated organizations that (i) need to know that information in order to process it on Legacy Driven’s behalf or to provide services available through Legacy Driven, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Legacy Driven websites, you consent to the transfer of such information to them.

We are committed to protecting your personal information, and will not disclose your personal information except as set forth herein. We may share your information with subcontractors that provide us with services. These services may include, among other things, helping us provide the Legacy Driven services that you request, helping to create or maintain our databases, helping to research and analyze the people who request services or information from us, helping to provide marketing or solicitation materials for our products or services, and/or helping to process payment card information. You may choose to submit information as part of a service or online community offered by Legacy Driven. Any information you choose to post, including personally identifiable information, may be available generally to the public, or to other members of the course or online community.

If you are a registered user of a Legacy Driven website and have supplied your email address, Legacy Driven may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Legacy Driven and our products. We primarily use our blog to communicate this type of information, so we expect to keep this type of email to a minimum. If you have consented to marketing, you may opt out later. You have a right at any time to stop us from contacting you for marketing purposes. If you no longer wish to be contacted for marketing purposes, please click on the unsubscribe link at the bottom of the email.

Legacy Driven will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to project administrators, employees, contractors, and affiliated organizations, as described above, Legacy Driven discloses potentially personally-identifying and personally-identifying information only when required to do so by law, if you give permission to have your information shared, or when Legacy Driven believes in good faith that disclosure is reasonably necessary to protect the property or rights of Legacy Driven, third parties, or the public at large. Information about our users, including personal information, may be disclosed or transferred as part of, or during negotiations of, any merger, sale of company assets or acquisition.

If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Legacy Driven takes all measures reasonably necessary to protect against the unauthorized access, use, alteration, or destruction of potentially personally-identifying and personally-identifying information.

Legal Grounds for Processing Personal Information

We rely on one or more of the following processing conditions:

  • our legitimate interests in the effective delivery of information and services to you;
  • explicit consent that you have given;
  • legal obligations.

Access to and Control of Personal Information

We give you the opportunity to opt-out of receiving communications from us and to view, correct or remove your personal information.

You have the right to request a copy of the information we hold about you. If you would like a copy of some or all your personal information, please follow the instructions at the end of this policy.

If you have received unwanted, unsolicited email sent via this system or purporting to be sent via this system, please forward a copy of that email with your comments to Privacy@LegacyDrivenMotorsports.com. We will promptly take action.

Legacy Driven user accounts can be edited by following these steps:

  1. Visit the login page of the respective Legacy Driven website accessible from “Website Login” link at the top of every webpage.
  2. Enter your username and password and agree to Legacy Driven’s Privacy Policy.  You will be redirected to your User Dashboard.
  3. Hover over your username in the upper right hand corner of the webpages.  From the drop-down menu, click the “Edit My Profile” link.
  4. Edit your profile as desired and click “Update Profile” at the bottom of the webpage to save the changes.

Retention of Personal Information

We will retain your personal information on our systems only for as long as we need to for Legacy Driven’s success. We keep contact information (such as mailing list information) until a user unsubscribes or requests that we delete that information from our live systems. If you choose to unsubscribe from a mailing list, we may keep certain limited information about you so that we may honor your request.

Legacy Driven will not delete personal data from logs or records necessary to the operation, development, or archives of Legacy Driven.

When deletion is requested or otherwise required, we will anonymize the data of data subjects and/or remove their information from publicly accessible sites if the deletion of data would break essential systems or damage the logs or records necessary to the operation, development, or archival records of Legacy Driven.

Rights in Relation to Your Information

You may have certain rights under data protection law in relation to the personal information we hold about you. In particular, you may have a right to:

  • request a copy of personal information we hold about you;
  • ask that we update the personal information we hold about you, or independently correct such personal information that you think is incorrect or incomplete;

Data Security

We have put into place reasonable security measures in an effort to protect personal information while it is under our control. Your account information is accessible online only through the use of a password. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Service by any person using your password. Please advise us immediately if you believe your password has been misused.

Website Analytics

Legacy Driven may collect statistics about the behavior of visitors to its websites. However, Legacy Driven does not disclose personally-identifying information other than as described in this policy.

We use AWStats, Webalizer, CloudFlare, and Google Analytics to analyze usage and traffic to this website. The information we collect is used to learn how our clients and users can be met with more useful, timely, and appropriate design and content.

Cookies

Additionally, information about how you use our website is collected automatically using “cookies”. Cookies are text files placed on your computer to collect standard internet log information and visitor behavior information. This information is used to track visitor use of the website and to compile statistical reports on website activity.
